As a user of the Bike Park, the customer or the legal representative for minor children is obliged to familiarize themselves with the safety rules or the Bike Park regulations. The customer acknowledges that the following terms and conditions are the binding contractual basis for the use of the Bike Park. The legal representative of minor children assumes liability for the children.

Sport-Panorama strives to maintain the lines in optimal condition to ensure the highest possible safety. Mountain biking is a risk sport associated with specific dangers. Therefore, each customer is urged to realistically assess themselves and their riding skills. Falls with damage to property, personal injuries (including serious ones) can result from these risks, even without the involvement or fault of others.

GENERAL

Every customer must take the utmost consideration for other people and refrain from anything that could lead to endangerment for themselves or others. Consideration must be given to typical hazards in the forest and open terrain and also due to other bikers. Therefore, precautionary measures must be taken by driving predictably and complying with the safety instructions. The use of the entire facility involves risks. Compliance with the safety instructions and the terms and conditions is solely the responsibility of the respective customer.

SCOPE AND DEFINITIONS

The following General Terms and Conditions (GTC) are agreed upon as the contractual basis for the use of the Bike Park for the contractual relationship between the ski school and rental Panorama GmbH (hereinafter "Sport-Panorama") and the customer (hereinafter "customer").

CONCLUSION OF CONTRACT

1. The use of the entire Bike Park of Sport Panorama GmbH is only for rental customers of Sport-Panorama for the rental duration of the (E-)bike or with a valid day ticket (available at Sport-Panorama). Tickets are not transferable to other persons.
2. Children under 10 years of age are only allowed to use the Bike Park accompanied by an adult or with a bike trainer from Sport-Panorama. The customer's age of majority must be proven by suitable evidence. For minor customers, a consent form signed by the legal representative must be submitted, unless the legal representative signs this declaration on-site. The legal representatives or adult companions agree to the terms and conditions and all terms of use (safety instructions and rules of conduct).

TERMS OF USE

1. The customer confirms that they are physically and mentally healthy and not under the influence of intoxicating or otherwise impairing substances, such as alcohol or drugs, and do not suffer from a disease or physical or psychological impairments that could lead to endangerment of themselves or others while using the Bike Park.
2. All customers must observe the GTC and safety instructions and rules of conduct, as well as all information boards, signs, and markings on the individual lines and elsewhere in the Bike Park. Instructions from the staff of the Bike Park must be followed.
3. The posted operating hours of the Bike Park must be observed. Regardless, the use of the Bike Park is only during daylight, i.e., from sunrise to just before dusk.
4. Only the established lines may be used by customers. Riding off the established tracks is not allowed. Shortcuts and cross-country driving are prohibited. Modifications to the tracks or structural changes are not allowed.
5. The Bike Park may only be used with E-mountain bikes and other mountain bikes suitable for this purpose, without child seats and trailers. Other, especially motorized vehicles as well as drones or other flying devices are not allowed in the entire Bike Park.
6. Sport-Panorama may partially or completely close the park for safety reasons in case of imminent danger, due to force majeure, e.g., extreme weather conditions, and other significant reasons. If Sport-Panorama is not responsible for these reasons, no (even partial) refund of

LIABILITY

1. The use of the facilities of the Bike Park is generally at the own risk of the customers. Parents are liable for their children.
2. We are not liable for damages resulting from non-compliance with our GTC and from ignoring the safety instructions and rules of conduct.
3. We are not liable for damages caused by circumstances for which we are not responsible.
4. For damages, we are liable – regardless of the legal reason – within the scope of liability for intent and gross negligence.
5. The exclusion of slight negligence does not apply for personal injuries and breaches of contractual obligations.
6. As far as our liability is excluded or limited, this also applies to the personal liability of our legal representatives, employees, workers, staff, and vicarious agents.
7. The customer is liable for damage to the facility or parts of the facility that are due to their fault.
8. The customer is also liable if damages are due to the culpable violation of the GTC and/or the safety instructions and rules of conduct.
